Terms of Service — DailyRecord

1Scope & Acceptance

This User Terms of Service Agreement (the "Agreement") is entered into by and between you (hereinafter referred to as the "User") and the provider of DailyRecord ("we", "us", or "our"). This Agreement governs your access to and use of DailyRecord through the web interface, iOS client, Android client, or any other platforms.

By registering, logging in, or using the Service in any manner, you acknowledge that you have read, understood, and agreed to be bound by all terms of this Agreement. If you do not agree, please immediately cease using the Service.

We may update this Agreement from time to time. We will notify you of updates through in-app notices or email. Your continued use of the Service constitutes acceptance of the updated terms.

Minors

The Service is intended for users aged 14 and older. Minors under the age of 14 are strictly prohibited from registering or using the Service. Minors aged between 14 and 18 must use the Service under the supervision and with the consent of a legal guardian.

2Account Registration & Security

Registration Info

You must provide a mobile phone number or email address and create a password to register. You represent and warrant that all registration information provided is accurate and true. You shall bear any consequences resulting from false or inaccurate information.

Account Security

You are solely responsible for safeguarding your account credentials. Do not share your password with anyone.
If you suspect unauthorized access or compromise of your account, reset your password immediately and contact us.
We shall not be held liable for any loss or damage arising from your failure to safeguard your credentials.

Single Account Limitation

Each individual may maintain only one active account. Automated, programmatic, or bulk registration of accounts is strictly prohibited.

Account Deletion

You may request account deletion at any time within the app settings. Upon request, your personal data and content will be irreversibly deleted after a 30-day cooling-off period. Please back up any critical records before requesting deletion.

3Description of Services

DailyRecord is a voice-first journal and diary assistant. Its core features include:

DayCard: One document card per day, supporting appended text, audio recordings, and images.
Voice-to-Text: Audio is transcribed into text using third-party ASR services.
AI Summaries: AI models analyze daily records to generate summaries, mood tags, and highlight action items.
Todo Extraction: Action items are automatically parsed and grouped into interactive checklists.
Periodic Reports: Weekly, monthly, and yearly diary reports are automatically consolidated.
Multi-device Synchronization: Real-time syncing across Web, iOS, and Android clients.

AI-driven tasks (transcription, summaries, emotion tracking) are processed asynchronously. Processing duration depends on network and backend load, typically completing in seconds or minutes.

We reserve the right to modify, suspend, or restrict any features of the Service at any time without notice, though we will make reasonable efforts to announce major feature changes in advance.

4Voice & Audio Data

Audio records constitute sensitive personal information. Please read this section carefully before using any voice recording features.

Microphone Access

Recording audio requires microphone permission on your device. We only access the microphone when you actively initiate a recording and do not record in the background. You can revoke this permission at any time in your device settings.

Audio Storage

Audio files are uploaded securely directly to our Object Storage (MinIO). Access is restricted via expiring presigned URLs to prevent public exposure.

Transcription Processing

Audio is sent via safe URLs to a third-party recognition model (Doubao AUC) for transcription. We keep the transcribed text as part of your document, and the audio files remain until you delete the associated records or delete your account.

Your Rights

You can delete individual messages or entries within the app at any time, which permanently removes the associated audio file from our object storage.

5AI Generated Content

Content Nature

This Service uses large language models (LLM) to summarize, identify emotions, and extract action items from your entries. These analyses are fully automated and do not reflect our views or professional recommendations.

Accuracy Statement

AI-generated outputs may sometimes contain inaccuracies, omissions, or misunderstandings. We make no express or implied warranty regarding the accuracy, completeness, or suitability of AI-generated content.

Data Usage

Your records are processed strictly to generate analysis and summaries for your account only. We do not use your diary text to train models or share it with other users.

6User Content & Intellectual Property

Your Content is Yours

You own all intellectual property rights to the texts, audio, and images you record and upload (the "User Content"). We claim no ownership over your User Content.

Limited License

In order to provide the Service (for storage, sync, audio playback, and AI parsing), you grant us a non-exclusive, royalty-free, sublicensable, limited license to process, parse, and transfer your content solely within the bounds necessary to deliver the Service.

Platform Intellectual Property

All app designs, code, assets, and trademarks belong to us and are protected under international intellectual property laws. You may not copy, reverse-engineer, or redistribute platform components without written authorization.

7Privacy Protection

We take data privacy very seriously and employ robust technical safeguards to protect your personal information:

All data transmissions use secure HTTPS / TLS encryption.
Passwords are salted and hashed using PBKDF2 (120,000 iterations); we cannot retrieve your raw password.
Audio files are protected by expiring, authenticated presigned links.
Your data is isolated securely; there is no social feature or sharing between users.
We do not sell your personal records or diaries to third parties.

8Prohibited Conduct

While using our services, you agree not to:

Upload illegal, pornographic, violent, hateful, or abusive content.
Record other individuals' voices or upload their photos without explicit consent.
Use bots, scrapers, or scripts to automate account registration or API access.
Attempt to reverse-engineer, crack, or bypass platform security features.
Use the Service for unauthorized commercial or promotional purposes.
Interfere with or disrupt our servers, database, or network systems.

9Third-Party Services

The Service relies on the following third-party infrastructure to function:

Doubao AUC Speech-to-text recognition service from ByteDance. Audio files are processed securely and not kept permanently by the ASR service.
LLM Providers Large language models used for diary summaries, emotional tracking, and action item extraction.
Object Storage Secure storage systems used to house your audio clips and uploaded images.

10Disclaimers

Service Availability

The Service is provided on an "as-is" and "as-available" basis. We do not warrant that the Service will be uninterrupted, error-free, or entirely secure. We are not liable for outages caused by force majeure or upstream cloud providers.

Mental Health Disclaimer

AI-generated mood tracking and summaries are for personal reflection only and do not constitute professional psychological or medical advice. If you are experiencing distress, please seek help from a qualified mental health professional.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits). Our total aggregate liability shall not exceed the amount paid by you to us in the preceding 12 months.

11Modifications & Termination

Suspension & Termination

We reserve the right to suspend or terminate your account if:

You violate any terms of this Agreement.
Your account remains entirely inactive for more than 365 consecutive days.
We decide to cease the operation of the Service.

Discontinuation Notice

If we permanently discontinue the Service, we will notify you at least 30 days in advance and provide an export mechanism so you can safely download your data.

Governing Law & Dispute Resolution

This Agreement is governed by the laws of the People's Republic of China. Any dispute arising out of or in connection with this Agreement shall be resolved through friendly consultations. If consultations fail, the dispute shall be submitted to the courts having jurisdiction over the location of the service provider.
